General Provisions

1. These Terms of Service define the rules for using the website available at muszynianka.pl (hereinafter: the “Service”), in accordance with the requirements of the Act of July 18, 2002, on Providing Services by Electronic Means (Journal of Laws of 2020, item 344, as amended).

Definitions

• Service Provider: Muszynianka Sp. z o.o. with its registered office in Krynica-Zdrój.
• Service: the website operated by the Service Provider at muszynianka.pl.
• User: any natural person using the Service.
• Electronic Service: a service provided electronically by the Service Provider to the User via the Service.
• Contact Form: an interactive form available on the Service that allows sending messages to the Service Provider.
• Terms of Service: this document.

Type and Scope of Services

1. The Service Provider provides the following electronic services via the Service:

• Providing informational content: presenting information about Muszynianka products, history, the mineral composition of the water, and company activities.
• Contact Form: enabling users to send inquiries to the Service Provider.
• Providing press materials: a Press Office section featuring downloadable materials.

2. Electronic services are provided free of charge, 24 hours a day, 7 days a week.

3. The Service Provider reserves the right to temporarily restrict access to the Service due to maintenance, updates, or technical reasons.

Technical Requirements

1. Using the Service requires meeting the following technical conditions:

• A device with internet access.
• An up-to-date web browser (Chrome, Firefox, Safari, Edge) supporting JavaScript and cookies.
• An active email account (if using the Contact Form).

2. The Service is optimized for both desktop and mobile devices (Responsive Web Design technology).

Rules of Using the Service

1. The User agrees to use the Service in accordance with applicable law, these Terms of Service, principles of social coexistence, and good customs.

2. In particular, it is prohibited to:

• Provide illegal content, including content that infringes upon the rights of third parties.
• Take actions that may disrupt the proper functioning of the Service, including attempting unauthorized access to the Service’s resources.
• Use the Service for purposes contrary to its intended use, including sending unsolicited commercial information (spam).
• Copy, modify, or distribute the content of the Service without the prior consent of the Service Provider.

3. The Service Provider may block access to the Service for any User who violates the provisions of these Terms of Service.

Intellectual Property

1. All content published on the Service, including text, photos, graphics, logos, trademarks, video materials, as well as the layout and composition of the Service, are the property of the Service Provider or entities with which the Service Provider has concluded relevant agreements. They are protected by the Act on Copyright and Related Rights and the Industrial Property Law.

2. Any use of the Service’s content beyond personal use requires the prior written consent of the Service Provider.

3. The name “Muszynianka”, the Muszynianka logo, and product names are registered trademarks. Their use without the Service Provider’s consent is strictly prohibited.

Liability

1. The Service Provider makes every effort to ensure that the information on the Service is up-to-date, reliable, and factual. The content on the Service is for informational purposes only and does not constitute a commercial offer within the meaning of the Civil Code.

2. Information regarding the mineral composition of the water, health properties, and mineral content is presented based on laboratory tests. It may vary slightly depending on the production batch, strictly within the limits permitted by applicable standards.

3. The Service Provider shall not be held liable for:

• Interruptions in the availability of the Service resulting from technical reasons (maintenance, failures, updates).
• Consequences of improper use of the Service by the User.
• Content published on websites linked from the Service (external services).
• The impact of computer viruses or other malicious software resulting from internet use.

Personal Data Protection

1. The Data Controller of the Users’ personal data is the Service Provider.

2. Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and Polish personal data protection regulations.

3. Detailed rules concerning personal data processing and the cookies policy are specified in the Privacy Policy.

Complaints Procedure

1. The User has the right to submit complaints regarding the functioning of the Service and the provided electronic services.

3. A complaint should include: the User’s first and last name or company name, email address, a description of the problem, and the date of the event subject to the complaint.

4. The Service Provider processes the complaint within 14 business days of its receipt and informs the User of the resolution electronically.

2. The Service Provider is not responsible for the content, privacy policies, or practices of these third parties.

3. Navigating to a third-party website is done entirely at the User’s own risk.

Final Provisions

1. The Service Provider reserves the right to amend these Terms of Service. Amendments enter into force on the day they are published on the Service.

2. For matters not covered by these Terms of Service, the provisions of Polish law shall apply, in particular:

• The Act of July 18, 2002, on Providing Services by Electronic Means.
• The Act of April 23, 1964: the Civil Code.
• Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

3. Any disputes between the Service Provider and the User shall be settled by the court competent for the registered office of the Service Provider, subject to mandatory provisions of law regarding court jurisdiction for consumers.

4. A consumer has the option to use out-of-court complaint and redress mechanisms, including via the Online Dispute Resolution (ODR) platform available at: ec.europa.eu/consumers/odr.
